O positivismo jurídico é predominantemente ensinado e aplicado há décadas por profissionais da área jurídica brasileira, geralmente com referência à construção teórica de Hans Kelsen (1881-1973), deixando à margem muitos outros estudos que oferecem importantes formulações e conceitos para a compreensão do Direito contemporâneo. Este artigo se junta a algumas poucas pesquisas sobre outros referenciais teóricos acerca do positivismo jurídico, analisando a regra de reconhecimento no pensamento teórico de Herbert Hart (1907-1992), apresentando-a como incremento e superação da teoria imperativista de (...) John Austin (1790-1859). A partir de pesquisa bibliográfica, mostramos que, em Hart, a regra de reconhecimento (modalidade de regra secundária) apresenta-se indispensável para a certeza necessária ao Direito, bem como para aferir a validade do sistema jurídico. In Heidegger’s thought, it is possible to recognize an accurate reflection about the pain that afflicts modern man, as well as a particular indication for its cure. In pain, man experiences his being destined to metaphysics like something incurable, which requires to think the topology of the gift of being. Pain and convalescence will be exposed in that topology, under the light of The Turn [die Kehre], The Event [Ereignis] and the line between Overcoming [Überwindung] and Twisting [Verwindung] of Metaphysics, (...) in order to recognize that, in Heidegger’s reflection, it is in pain “itself” where the cure of the incurable can be possible: the passion of human finitude, the experience of the giving of being and the care of nothingness. Before overcoming [überwunden] the Metaphysics, with its intention of appropriate the being, Metaphsyisics must be reestablished [verwunden] in its inappropriate truth. (shrink)

This article examines the legacy of Gramscian thought in Anglophone social sciences. It focuses in particular on three currents or disciplines, namely Cultural Studies, Anthropology, and Gender Studies. All three have sought and sometimes found in Gramscian categories a number of theoretical and political instruments through which to think the structures of domination, individual or collective subjectivity, and their relation to culture, in particular through the use of the dialectical relationship of hegemony/subalternity. Demonstrating how Gramsci was received in the intellectual (...) and political Anglophone context, the article highlights certain genealogies which have sometimes led to what amounts to a number of fully-fledged “translations” of Gramscian concepts, but also to a series of “lighter”, more distant uses. In this perspective, the article focuses on the translation of Gramsci undertaken by the New Left in the Seventies, insofar as this detour has proved of capital importance for the successive interpretations of Gramscian theories in the Anglophone social sciences. By the time of the Prolegomena , Husserl took phenomenology to be a philosophical method that stands in opposition to naturalism, of which psychologism was supposed to be a particularly pernicious instance. Husserl was not the only philosopher at the turn of the century to oppose psychologism. Among his fellow campaigners one finds Frege, who played a decisive role in the development of so-called analytic philosophy, and Dilthey, who stands at the roots of contemporary hermeneutics. When it comes to issues (...) concerning the origins of phenomenology, as opposed to other traditions, anti-psychologism in particular, and anti-naturalism in general, cannot be used as discriminative criteria. Nietzsche’s four Untimely Meditations are a set of works generally rather neglected of this author. They are, however, the outcome of a project placed in a critical situation, along the development of Nietzsche as philosopher. By beginning, particularly, with an analysis of the first Meditation, David Strauss, the Confessor and the Writer, and of the third one, Schopenhauer as educator, we will try to show two philosophical perspectives which, launched in the Meditations, will carry Nietzsche’s path until its end: the (...) path of an “ontology of the modernity”, according with the expression of Foucault, and that of a philosophy as “way of life”, according with the expression of Hadot. A experiência da conversão é habitualmente ligada ao contexto religioso.Contudo, autores como Pierre Hadot e Michel Foucault destacaram a presença de uma conversão filosófica, ao longo dos séculos. Se é possível verificar como nas tradições apocalípticas de caráter religioso se instaura uma conversão que visa alcançar uma manutenção do mundo em épocas de crise, também no contexto filosófico a diagnose nietzscheana do niilismo foi seguida por experiências filosóficas, como as de Simone Weil e de Georges Bataille, que visam a definição (...) de uma vida filosófica capaz de enfrentar o apocalipse. Através da abordagem do antropólogo Ernesto De Martino, tentarei mostrar, por um lado, o caráter apocalíptico-cultural do niilismo, e, por outro, como uma conversão filosófica, enquanto experiência interior, pode encarar este hóspede do nosso tempo. It is by now common knowledge that analytic philosophy has its roots, at least partially, in phenomenology. It is less known that analytic philosophy has inherited part of its original antipsychologism precisely from phenomenology, or rather from early phenomenology. The present article traces the historical brackground of antipsychologism, starting with the debate on the philosophical foundations of psychology during the 19th century. It appears that naturalistic antipsychologism, the early phenomenologists position, has to be distinguished from transcendental antipsychologism, as it was (...) promoted most prominently by Husserl after 1907. The article explains how this divide emerged from different conceptions of the specificity of the philosophical inquiry into the mind, as opposed to its psychological study. Adopting the naturalistic approach, the early phenomenological as well as the analytical school have reacted to the antipsychologistic challange by eliminating subjective elements from the content of the mind. Resumen Tomando como motivo una conjetura de Lacan dirigida a Heidegger, referida a lo que sería la metafísica y lo que determinaría su historia y sus efectos, el presente trabajo pretende poner en relación la topología lacaniana y la topología heideggeriana. Ahí donde Lacan traduce a Heidegger, veremos que lo que asoma, y que parece haber pasado inadvertido, es la cuestión topológica del agujero y los efectos políticos que implica velarlo. En definitiva, cuando se lleva hasta sus últimas consecuencias lo (...) que implica habitar el lenguaje, veremos que el sentido que ambos autores imprimen a su topología, luego de coincidir, diverge.Taking as a motive a conjecture of Lacan directed to Heidegger, referred to what would be the metaphysics and what would determine its history and its effects, the present work tries to put in relation the Lacanian topology and the Heideggerian topology. Where Lacan translates Heidegger, we will see that what appears, and that seems to have gone unnoticed, is the topological question of the hole and the political effects involved in watching it. In short, when it takes to its ultimate consequences what it means to inhabit the language, we will see that the sense that both authors print to their topology, after agreeing, diverges. (shrink)

The recognition of self as other and others as self continues to be one of the greatest challenges to the ethos necessary for institutions, public and private, engaged in hospitality. Indeed, hospitality is an intrinsic part of the recognition of the common and communal bond in which each human person can rediscover a sense of belonging and his or her own specific creaturality, the fruit of mutual and diverse encounters in the relationship between peoples and among peoples. Inspired by papal (...) words and documents, as well as philosophical and political debates of jus, here we defend the value of experiences of mutual bonds of memory and humanitarian revelation, in which a clear distinction between demos and ethnos can be established. By questioning globalization in its economic and financial promises, unrelated to human dignity and hospitality, it reveals how paths to peace are sustained by the synodal consolidation of human rights and fundamental freedoms. Thus, a distinction must be made between claims of ethnic recognition, on the one hand, and the promises of global recognition of civil rights and pseudo-cultural acquisitions, which have in recent years risen to legal protection and political guarantee; on the other hand, it is pointed out that true recognition of the human person as constituted in a relational, social and community dignity is only beyond the economic-financial constraints of globalization. Durante las primeras décadas del siglo XX no abundan traducciones españolas de los Grundlinien der Philosophie des Rechts. En 1937, se publica en la Editorial Claridad la traducción de Angélica Mendoza, la cual no sólo representa la primera versión argentina de los Grundlinien, sino que también es la primera y única completa que se ofrece al mundo hispano-parlante hasta 1975 cuando aparezca la traducción de J. L. Vermal. Pero esta primera edición completa de la obra no puede omitir el contexto (...) político-cultural al que pertenecieron tanto la traductora como la editorial, ni tampoco los recursos de los que se valió Mendoza para realizar esta tarea. En el siguiente trabajo nos proponemos examinar críticamente la versión realizada por Angélica Mendoza de los Grundlinien, sosteniendo que hay dos mediaciones determinadas que intervienen en el acceso de la obra hegeliana: una de carácter político y la otra de carácter textual. En primer lugar, considerando la fecha de publicación de la traducción, pretendemos mostrar los elementos que implican el rol mediador del marxismo para el acceso de los Grundlinien. En segundo lugar, mediante una valoración crítica de la traducción, destacaremos el rol mediador que cumple la versión italiana de Messineo tanto para beneficio de la traducción en español, como para los problemas de comprensión que se derivan de este recurso indirecto. RIASSUNTO: Il presente studio sui presupposti imprescindibili di ogni etica personalistica si propone di confutare e di superare una volta per sempre il relativismo, l’utilitarismo e il fondamentale scetticismo delle etiche contemporanee, fondate sull’assolutizzazione dei fatti, del costume, delle tendenze culturali storicamente e socialmente prevalenti nella nostra epoca presente. Tale atteggiamento è tollerante e pluralista soltanto in apparenza, perché nella realtà è ipocritamente intollerante verso ogni altra etica che non sia quella dell’edonismo ordinario, del consumismo e dell’acquiescenza alle richieste della (...) tecnica ed agli imperativi della ricerca scientifica rivolta unicamente a fini di utilità e di conquista di comodità e di agevolazioni per il genere umano. L’etica che intendiamo proporre è incentrata sull’idea di “persona”; secondo il nostro modo di vedere la persona è apertura assoluta verso il tutto dell’essere ed è eminentemente attualità spirituale. Non lo è perciò unicamente un’attività razionale universale, ma coinvolge fondamentalmente anche l’emotività, la volontà e il desiderio. Secondo noi l’esigenza fondamentale della persona spirituale è la ricerca della felicità, e tale ricerca si impone con la cogenza di un vero e proprio “imperativo etico”, e la sua funzione è quella di liberarci dalle costrizioni del costume, della falsa e artificiale morale corrente ordinaria che si assoggetta soltanto ai fatti e alla ricerca dell’utile e del conveniente. Liberazione e imperatività sono gli elementi essenziali per la ricerca della felicità, e questa a sua volta consiste nella promozione di un crescente accordo e di una sicura armonia di ogni persona con se stessa. L’imperatività dell’obbligazione con la quale ci leghiamo fedelmente all’impegno squisitamente spirituale di affermare la nostra libertà dalla servitù dei fatti e dall’attaccamento a ciò che è soltanto provvisorio e povero di autentica soddisfazione interiore conferma e promuove la liberazione spirituale in ogni persona. RESUMO: O presente estudo pretende refutar e superar definitivamente o relativismo, o utilitarismo e o ceticismo fundamental das éticas contemporâneas, fudamentadas na absolutização dos fatos, do costume, das tendências culturais historicamente e socialmente dominantes na época presente. Tal atitude é tolerante e pluralista somente na aparência, porque na realidade é hipocritamente intolerante a qualquer outra ética que não seja a do hedonismo ordinário, do consumismo e da aquiescência às demandas da técnica e aos imperativos da pesquisa científica dirigida unicamente aos fins da utilidade e da conquista do bem-estar e de facilitações para o gênero humano. A ética que pretendemos propor está centrada na ideia de pessoa. Na nossa opinião, a pessoa é abertura absoluta para o todo do ser e é eminentemente atualidade espiritual. Não é, portanto, unicamente uma atividade racional universal, mas envolve fundamentalmente também a emotividade, a vontade e o desejo. A exigência fundamental da pessoa espiritual é a busca da felicidade. E tal busca se impõe com a força de um verdadeiro e próprio “imperativo ético”. E a sua função é a de nos libertar das constrições do hábito, da falsa e artificial moral ordinária que se submete somente aos fatos e à busca do útil e do conveniente. Libertação e imperatividade são os elementos essenciais para a busca da felicidade e esta, por sua vez, consiste na promoção de um crescente acordo e de uma harmonia sólida de cada pessoa consigo mesma. A imperatividade da obrigação com a qual nos ligamos fielmente ao compromisso espiritual de afirmar a nossa libertade da escravidão dos fatos e do apego àquilo que é somente provisório e pobre de autêntica satisfação interior confirma e promove a libertação espiritual de cada pessoa. El artículo analiza el problema del comprender a partir de las nociones de des-alejamiento, partida y trauma. Mientras que la comprensión tradicionalmente ha sido abordada desde una noción clásica de representación, asociada a la presencia y la disponibilidad, aquí se explora una vía del comprender que recoge ciertos aportes del pensamiento de Werner Hamacher y Sigmund Freud, que arrancan de una reformulación de la noción predominante de representación. La lectura minuciosa, apegada al texto, de un poema de Rilke, que implica (...) además su traducción, permite poner a prueba dichos aportes y desarrollar las ideas de sustracción, partida y des-alejamiento sobre el trasfondo del célebre juego freudiano del Fort/Da. Todo esto, con el fin de esbozar las consecuencias de tal ejercicio para una comprensión detraída del comprender a partir del antecedente de los autores mencionados. (shrink)

Lire un texte du passé d’un point de vue philosophique, et non pas seulement historique ou philologique, signifie se situer par rapport à lui, ou inversement situer le texte par rapport à un débat actuel. Seulement, voilà, qu’est-ce qu’un débat actuel? Est-ce que toute discussion philosophique qui se produit en l’année 99 dans une salle d’université quelconque mérite le titre de contribution — qu’elle soit négligeable ou éminemment signifiante — à la philosophie actuelle? Il existe une foule de débats qui (...) se produisent simultanément. Nous croyons tous participer à un débat actuel et la grande majorité d’entre nous ne connaît aucun autre débat. Qu’on le veuille ou non, nous sommes bien loin d’en avoir fini avec le provincialisme philosophique. (shrink)

In Systčme d'Epicure, La Mettrie presents a hypothesis on the origin and evolution of animals which owes much both to the fifth book of Lucretius's poem and to Montaigne's Apologie de Raimond Sebond. Claiming that Nature's operations are as unintentional and as amoral as the play of children, the French physician argues against all teleological explanations of the physical constitution of living beings. Nature's first attempts at creating individual beings must therefore have been characterized by frequent mistakes, some of which (...) are still to be seen in a few monstruous cases. Evolution is assured only through a process of trial and error, where the elimination of "unfit" combinations is due to the inability of specific animals to reach adulthood and give birth to offspring. The perfection of a living being is not to be evaluated by means of comparisons to a preexisting model but depends instead on the intensity of this being's sexual needs, which compel it to seek pleasure and to develop its mental skills. Le riflessioni di Leibniz intorno ai problemi della teodicea sono caratterizzate, negli anni che precedono la Confessio philosophi, dall’influenza del pensiero di Valla, Lutero, Bisterfeld e Hobbes. Ad un iniziale atteggiamento volontaristico, secondo il quale l’onnipotenza di Dio è sufficiente a garantire la giustizia del governo del mondo, succede un primo ripensamento, evidenziato soprattutto nel Von der Allmacht und Allwissenheit Gottes und der Freiheit des Menschen. In questo scritto del 1671 Leibniz riconosce la drammaticità del problema del male e attribuisce (...) agli abusi linguistici dei filosofi la responsabilità dello stato di discordia nel quale si trova la cristianità; in particolare egli ritiene che le nozioni di possibilità e necessità possano essere riportate al loro vero significato attraverso l’analisi del linguaggio comune, che rivela la fallacia del fatalismo. Contro la riduzione del peccato a semplice “non-ente” e la pretesa della scienza media di sottrarre l’uomo alla predeterminazione, Leibniz afferma che Dio non si limita a permettere i peccati ma ne vuole positivamente l’esistenza, ricondotta però ad armonia attraverso la proporzione tra colpa e pena.
